Types of Grants of Representation
There are two primary types of grants in the Cayman Islands:
1. Grant of Probate
Issued where the deceased left a valid Cayman Islands will naming one or more executors. The executor applies for probate and once granted, is authorised to manage and distribute the estate in accordance with the will.
2. Letters of Administration
Issued where:
- The deceased did not leave a will, or
- The will is invalid or does not name an executor, or
- The named executor has died or cannot act.
In these cases, the court appoints an administrator, typically the next of kin, to handle the estate based on the rules set out in the Succession Act (Revised).
