How Patents Work in the Cayman Islands

Patent protection in the Cayman Islands is governed by the Patents Act (2016 Revision). Unlike trade marks, patents cannot be filed directly in the Cayman Islands. Instead, protection is available through the extension of a granted UK patent. This means that to secure rights locally, you must first hold a valid UK patent granted by the UK Intellectual Property Office (UKIPO).

Once the UK patent is granted, it can be extended to the Cayman Islands by filing the appropriate documentation with the Cayman Islands Intellectual Property Office (CIIPO). This extension grants the patent holder the same exclusive rights in the Cayman Islands as they hold in the UK, namely, the right to prevent others from making, using, selling, or importing the invention without permission.
