Vessel Eligibility and Name Reservation

The first step in the registration process is confirming the vessel’s eligibility under Cayman Islands law, including ownership qualification, and coordinating with appropriate technical advisers on safety compliance, tonnage, survey, classification, and any applicable deletion or transfer requirements. Clients must also reserve an acceptable vessel name and select a Cayman port of registry, currently George Town (Grand Cayman), The Creek (Cayman Brac), Bloody Bay (Little Cayman), or any other port that may be prescribed by Cabinet. Name availability, reservation period, and documentation requirements should be confirmed directly with CISR at the time of application.

 

Ownership Requirements and Representation

Ownership of a Cayman-flagged vessel must be clearly established and legally compliant. In general, the Merchant Shipping Act, 2024 requires a majority interest in the vessel to be owned by one or more qualified persons. A separate demise charter registration route may also be available for a ship of twenty-four metres or more in length where the statutory requirements are satisfied, including a qualifying charter by demise to a qualified charterer. Where required under the Merchant Shipping Act, 2024 and CISR practice, a Cayman Islands Representative Person must be appointed; in joint ownership cases where no Representative Person is otherwise required, either a resident Representative Person or a resident managing owner must be appointed. Owners may separately appoint an Authorised Person to handle the registration process on their behalf, but the Representative Person and Authorised Person roles should be treated as distinct appointments.

Document Submission and Registry Process

To complete the registration, CISR requires submission of the relevant forms and supporting documents, which may include evidence of title, a builder’s certificate or bill of sale, survey or measurement documentation, an international tonnage certificate where applicable, evidence of incorporation and good standing for the owning entity, and any applicable deletion certificate or transcript. We advise on the Cayman legal aspects of these requirements and coordinate with surveyors, classification societies, foreign counsel, and other advisers where non-Cayman or technical documents are required. Once the Registrar is satisfied, CISR will issue a Certificate of Registry, commonly referred to in practice as a Certificate of British Registry, and, where applicable, a Carving and Marking Note, which sets out how the vessel must be physically marked. If a Carving and Marking Note is issued and not duly completed and returned to the Registrar of Shipping within three months of issue, the Registrar may cancel it and treat the application as withdrawn.
